I have no experience what so ever when DWP investigate someone and decide they are being fraudulant. We all fear being photographed on our ‘better days’.
Well, a lady sent an email to me about DWP saying she was a LIAR and no one would help her.
So, between the two of us we are doing the best we can to fight her case. The problem is, I have never done this before.
Yes, I have won a few Tribunals, but less than 10 I think off the top of my head. As I HATE them. They exhaust me, I get so tense and stressed as its literally in front of a judge.
It takes me at least 25hours to work on the pack to submit. This is when its for people that I meet a Tribunal level only.
When I work with people from Mandatory Reconsideration level, it is easier. When I meet people at the start, we simply do NOT get to Tribunal level. Well so far.
Anyway. This has been extremly overwhelming. There is so much to this case as the fraud team looked at her social media, they spoke to past employers. And of course questioned her under caution.

What is really causing us issues, is the shit advice she was given at the very start of her claim. She was told ONLY tell them about your BAD DAYS.
So, this means that every time she is able to leave the home, which none of us can do on a bad day (in my experience); its like she lied. FFS if you are reading this and thinking about PIP. WATCH MY GUIDES.
My clients do not stand the risk of this level of investigation as we are all HONEST and explain ON AVERAGE so if we do go out we let them know approx. how often we manage this.
Look, I filmed this video when I was really tired, I do cry and get upset and angry. But I needed to get it off my chest. We have been working on this for months now.
And to be honest with you, its only in the past couple of weeks that it clicked for me in my head how to put together the submission pack.
The submission pack is CRITICAL in a Tribunal. You cannot rush it. And at least 3 times in the past month, she has had to wait for me whilst my body shut down.
The guilt I have felt for her over this case is enormous. She is always understanding when my body won’t work right. But, I stand by:
She should not have been stuck with a fucking YouTuber as the only person who was willing to help
She should not be stuck with someone who is chronically ill and goes silent at times as she is asleep! Or trying to earn money whilst awake to pay the bills
I have spoken to her on many occasions. Every single time we have talked about her life, my notes ALL match. When she explains her condition and her daily life, as she is simply telling me the truth. Her story is always the same.
She scores ENHANCED in both sections of PIP. If she was a client doing a claim I would be saying there is no question you will WIN.
But, due to the severity of the case and the fraud team being involved I have no idea whatsoever on how she will be treated. Will they be fair? Will she be treated the same as everyone else?
I just don’t know. When we are through it, if she is still comfortable sharing, I will update you. Of course, her mental health is priority so I support whatever she wants, including if she never wants me to mention her again. I will honour whatever she wants. As I know we all agree.

Just in case you are wondering, she is no longer fit for work and she has lost her PIP funding, of course I am NOT charging her for my time.
I always have a flow of people that I help that are in difficult situations as I think its the right thing to do. I want her to know she IS believed as we (those of have experienced PIP) understand this process can break us.
She IS telling the truth.

They are extremely corrupt & prey on vulnerable service users.
I was investigated in Feb 2016 because on a few dates I received my ESA or PIP I had more than £6,000 in the bank account. It didn't matter that a few days after my ESA or PIP payment there was a payment for my credit card bill going out which would have taken the money in the account to well below the £6,000. For this I had to pay the DWP back £45 plus a £40 charge, I sent them a cheque for £85 but they claimed not to have received it and were going to deduct £11 plus per week from my benefit so I contacted the bank and they said that it was cashed by the DWP 9 days after the date on the cheque. When I told them they had cashed it they admitted it was an error and I should disregard the letter but my first ESA payment was over £22 short so I contacted them again and they gave the same excuse that I owed them £85 so I sent them the email that my bank sent me and gave them 7 days to pay the money or I would take county court action, they paid up in 6 days.
